Definition of Judicial Commission
Judicial Commission (KY) is a state institution established based on the Constitution of the Republic of Indonesia 1945. Which Judicial Commission has the authority to propose the appointment of justices of the Supreme Court and other powers, namely in the context of maintaining and upholding honor, nobility of dignity & judge behavior.
other than that, The Judicial Commission is an independent state institution which means that in exercising its authority the judicial commission is free from interference and the influence of other powers..
The Judicial Commission is responsible for the public through the House of Representatives (DPR) by preparing and publishing annual reports and opening various channels of complete information, effective and accurate
The powers of the Judicial Commission
It has been stated in Article 13 Law Number. 18 Year 2011 on Amendment to Law No. 22 of the Year 2004 about the Judicial Commission. So in Article 13 Law No. 18 Year 2011 that the Judicial Commission has authority, as follows:
- Propose the appointment of chief justices & ad hoc judge at the Supreme Court (MA) to Parliament for approval.
- Maintain and uphold honor, nobility of dignity & judge behavior
- Establish a Code of Ethics and Code of Conduct for Judges (KEPPH) together with the Supreme Court (MA).
- Maintaining and enforcing the implementation of the Code of Ethics of the Judges' Code of Conduct (KEPPH).
The duties of the Judicial Commission
It has also been stated in Article 14 Law Number. 18 Year 2011, which in exercising its authority in Article 13 point A, namely proposing or proposing the appointment of Supreme Court justices & ad hoc judge for the Supreme Court (MA) to the House of Representatives (DPR) to propose this, Judicial Commission (KY) have such a task:
- Conduct or register candidates for Supreme Court justices
- Selection of Supreme Court judges
- Appointing or appointing a candidate for the supreme judge
- Nominate a candidate for Supreme Court justices to the DPR.
other than that, in Article 20 Law Number. 18 Year 2011, in order to maintain and uphold honor, maintain dignity, and also the behavior of judges, The Judicial Commission has the following tasks :
- Monitor and supervise the behavior of judges
- Receive reports from the public in matters relating to violations of the Code of Ethics & Judge's Code of Conduct (KEPPH)
- Perform verification, and clarification, as well as investigations into reports of alleged violations of the Code of Ethics & Judge's Code of Conduct (KEPPH) closed.
- Decide whether or not reports of alleged violations of the Code of Ethics are true or not & Judge's Code of Conduct
- And so on, take legal or other steps against individuals, groups of people or legal entities that undermine the honor and dignity of judges

Rights and Obligations of the Judicial Commission
In addition to having duties and authority, the judicial commission also has rights and obligations, both of which must be carried out as well as possible. So, The Judicial Commission as a Judicial institution has the following obligations :
- Proposing or proposing the Appointment of Supreme Court Justices
- Conducting or registering candidates for the Supreme Court
- Conduct selection of Supreme Court justices
- Designate or determine the candidate for the Supreme Judge
- Nominate candidates for Supreme Court Justices to the House of Representatives.
- Maintain and always Uphold Honor, and Noble Dignity and also the Behavior of Judges
- Receiving reports of public complaints regarding the behavior of judges (There is a violation)
- Examine alleged violations of judge behavior
- Make a report on the results of the inspection in the form of recommendations submitted to the Supreme Court and the actions submitted to the Head of State / President and Parliament.
Functions of the Judicial Commission
If concluded, based on the explanation above, The main function of the Judicial Commission is as follows :
- Propose the appointment of chief justices
- Maintain and always uphold honor, and nobility of dignity, and the behavior of judges.
This function is also at the same time a direct authority granted by our constitution. And the granting of this direct function cannot be separated from the corridors of reform in all fields, particularly in justice reform.

The position of the Judicial Commission (KY) has been regulated in the provisions of Article 1 Point 1 of Law Number. 22 Year 2004 regarding the Judicial Commission which reads:
"The Judicial Commission is an Indonesian state institution as stipulated in the Constitution of the Republic of Indonesia (NKRI) 1945”.
